Abstract: The term “criminal gray non-adjudication” named by the author of this paper refers to the phenomenon that judicial organizations won’t make adjudication because lack of clear regulations in the criminal procedure law, but actually the adjudication should be made if viewed from legal spirits and the influences on the parties,. This phenomenon existing in the judicial practice will jeopardize the interests of a country and parties, hence it’s necessary to create measures of rights remedy to protect the interests of parties..
