-—兼評憲法中規定的審判獨立條款

摘要
司法獨立是西方國家乃至世界大多數國家司法制度的基本原則之一。我國現行憲法第126條規定：“人民法院依照法律規定獨立行使審判權，不受行政機關、社會團體和個人的干涉”；第131條規定：“人民檢察院依照法律規定獨立行使檢察權，不受行政機關、社會團體和個人的干涉”。但其在司法實踐中，真正意義上的司法獨立或者審判獨立在世界任何一個角落都未實現。本文將從司法獨立的歷史淵源入手，論述了司法獨立的淵源、發展、司法獨立的內涵，以及我國目前司法獨立的狀況，最后將從給出對策落筆。

On Judicial independence

Abstract
The judicial independence is one of the basic principles of the judicial system of most countries in western countries and even world. Judicial independence is the guarantee of just judicial system. Article 126 of current constitution of our country stipulates: “the people's court administers justice independently according to the legal provisions, is free from any inference by administrative organ, public organization and individual ”, article 131 stipulates: “ the people's procuratorate exercises the right of procuratorial work independently according to the legal provisions, is free from any inference by administrative organ, public organization and individual ”. But the fact is not like this . This text will proceed with historical origin of the judicial independence, describe the intension of the origin, development, judicial independence of the judicial independence, and the state of the judicial independence at present of our country, will start to write or draw from the countermeasure of providing finally.
